By hiring the services of Ship Shippers USA, operated by GARLAS LLC, in writing, by phone, or orally, the customer agrees to be bound by this terms and conditions contract (hereinafter, the "Contract").

Rights and Duties

  1. Boat Ownership
    The Client guarantees that they are the legally registered owner of the transported boat (hereinafter, the "Boat"), or have been authorized by all owners to enter into this Agreement with GARLAS LLC, DBA Ship Shippers USA for the transportation of the Boat.
  2. Contract Cancellation
    If the Client cancels this Agreement, they must pay GARLAS LLC a minimum cancellation fee of $150.00. Additional charges may apply if the boat is not available on the agreed transportation date.
  3. Financial Responsibility
    The Client shall be responsible for the payment of all amounts due to GARLAS LLC, including advances, additional disbursements, and collection costs.
  4. Personal Belongings
    Personal belongings are not allowed to be left on the boat. GARLAS LLC shall not be responsible for the loss or damage of personal belongings not factory-attached to the boat.
  5. Payment Method
    Unless otherwise agreed, the Client must pay all amounts to GARLAS LLC or the carrier upon delivery, in cash or via certified funds.
  6. Additional Costs
    The Client shall bear any additional costs arising from storage, towing, or delivery caused by non-compliance with the terms of this Agreement with GARLAS LLC.
  7. Liability for Damages
    The liability of GARLAS LLC ends once the carrier takes possession of the boat. Any damages occurring during transportation shall be the carrier's responsibility.
  8. Liability Exclusions
    GARLAS LLC shall not be liable for damages caused by:
    • Acts of force majeure (acts of God, extreme weather conditions, etc.).
    • Pre-existing conditions of the boat.
    • Overloading or improper preparation of the boat by the Client.
  9. Insurance
    The Client must ensure the boat is covered by insurance throughout the entire transportation process.
  10. Boat Preparation
    The Client is responsible for preparing the boat for transportation, including the removal of loose or fragile accessories.
  11. Indemnification
    The Client agrees to indemnify and hold harmless GARLAS LLC from any claims, costs, or losses arising from breaches of this Agreement.

Procedures

  1. Operations Authorization
    GARLAS LLC, operating as Ship Shippers USA, is authorized by the Federal Motor Carrier Safety Administration (FMCSA) and complies with all applicable federal regulations.
  2. Delays
    In case of unforeseen delays, the Client agrees to pay GARLAS LLC the full freight amount without deductions and document any damages on the bill of lading upon delivery.
  3. Oversized or Inoperable Vehicles
    An additional charge of $250 will apply to oversized or inoperable boats unless previously reported.
  4. Agent Designation
    If the Client is unable to be present at pickup or delivery, they must designate an authorized agent to act on their behalf.

General Provisions

  1. Entire Agreement
    This Agreement constitutes the entire contract between the Client and GARLAS LLC. Any modifications must be in writing and signed by both parties.
  2. Jurisdiction
    All disputes shall be resolved in the courts of Broward County, Florida, where GARLAS LLC is headquartered.
  3. Waiver of Claims
    The Client waives any claims based on ignorance or misunderstanding of these terms and agrees to indemnify GARLAS LLC for any costs arising from such claims.

GARLAS LLC operates Ship Shippers USA under these conditions, ensuring legal and regulatory compliance in boat transportation across the United States, Puerto Rico, and Central America.
